Welcome to the ThePoultryDoc.com website and related sites, applications, and digital services (“The Poultry Doc Site” or “Site”), an online information, diagnostics, and communications service provided by ThePoultryDoc, Inc. and its affiliates (“The Poultry Doc,” “we,” “us”). These Terms of Use cover all uses of this Site. Additional conditions, restrictions, and policies — including our Privacy Policy — may also apply and are posted or referenced on the Site. California residents may also have additional rights under the California Consumer Privacy Act (CCPA/CPRA), which are described in our Privacy Policy and available at our Privacy Rights Request Portal.
Not Veterinary Advice
The content, products, and services offered on this Site are intended to educate poultry owners on flock health, husbandry, and veterinary issues that may affect their birds. Nothing in the content, products, or services should be considered, or used as a substitute for, in-person veterinary advice, diagnosis, or treatment. This Site and its services do not constitute the practice of veterinary medicine unless provided directly by a licensed veterinarian in compliance with applicable laws and regulations.
Our AI tools and symptom checkers are provided for educational and preliminary triage purposes only. These tools use automated processing to assist in organizing and presenting health information; they do not replace the professional judgment of a licensed veterinarian and are not used to make final clinical determinations. All diagnostic results and treatment recommendations provided through our mail-in testing services will be reviewed by licensed veterinarians. You should always consult a qualified poultry veterinarian for diagnosis and treatment, including advice specific to your flock's needs.
Automated Decision-Making Notice: Certain features of this Site use automated tools to triage, organize, or present health information based on your inputs. These tools are used for educational support only and do not constitute significant automated decisions about your health or your flock's health care. Emergency Care
If you have an emergency or suspect that your bird is in urgent need of care, seek immediate assistance from an in-person, licensed veterinarian or an emergency veterinary facility. Do not rely solely on this Site, its AI tools, or any remote communications for emergency situations.
We make no guarantees that any particular service or product offered through this Site is safe, appropriate, or effective for every bird or every flock.
Modification of Terms
The Poultry Doc may modify these Terms of Use at any time. For material changes to these Terms, we will provide at least 14 days' advance notice via email or a prominent notice on the Site prior to the change taking effect. Your continued use of the Site after the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Site.
Intended for Adult Users
The Site is intended for use by individuals 18 years of age or older.
Users Under 16 — California Residents: Under the California Consumer Privacy Act (as amended effective January 1, 2026), personal information of users under the age of 16 is classified as sensitive personal information. If you are under the age of 16, or are a parent or guardian of a user under 16, you have the right to limit our use and disclosure of that user's personal information. Users under 16 may only use this Site with verified parental or guardian consent. We do not knowingly collect personal information from users under 16 without such consent. If you believe a user under 16 has provided us with personal information without parental consent, please contact us immediately at legal@thepoultrydoc.com. Parents and guardians of users under 16 may submit a Notice of Right to Limit request using our Privacy Rights Request Portal.
Users under 18 who are 16 or 17 years of age may use the Site only with the assistance and permission of a parent or guardian.
Acceptable Use
You agree not to:
- Use the Site in violation of local, state, national, or international laws.
- Distribute advertising or other unsolicited material.
- Post or transmit unlawful, obscene, defamatory, threatening, or harassing material.
- Interfere with or attempt to gain unauthorized access to the Site or related systems.
- Use bots, crawlers, or scraping tools to extract data without written permission.
- Circumvent, disable, or interfere with any privacy control, opt-out mechanism, or consent management feature of this Site, including Global Privacy Control (GPC) browser signals.
Account Setup and Security
To access certain features, you may be required to create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the confidentiality of your login credentials.
- Accept responsibility for all activity that occurs under your account.
We may suspend or terminate accounts at our discretion for violations of these Terms.
Privacy Settings and Opt-Out Confirmation: Your account includes a Privacy Settings panel where you may manage your privacy preferences, including opting out of the sale or sharing of your personal information. When a valid opt-out request is received — including via a Global Privacy Control (GPC) browser signal — we will process your request and display confirmation of the opt-out in your account privacy settings (e.g., “Opt-Out Request Honored”). Orders and E-Commerce
The Poultry Doc offers products and services including educational materials, diagnostic kits, and veterinary consultations. We reserve the right to limit or refuse orders at our discretion.
Prescription Products: Certain medications or treatments require a valid prescription from a licensed veterinarian. Prescriptions will only be issued in compliance with applicable veterinary practice laws, and there is no guarantee a prescription will be provided. For California-based clients, prescription issuance is further subject to the requirements of California Business and Professions Code § 4826.6, including applicable Veterinarian-Client-Patient Relationship (VCPR) standards for telemedicine.
User-Generated Content
If you submit content (reviews, posts, photos, etc.), you agree it will not violate laws, infringe on others' rights, or contain harmful material. By submitting content, you grant The Poultry Doc a royalty-free, irrevocable license to use, reproduce, and distribute it in connection with our services. We reserve the right to review, edit, or remove any user-generated content at our discretion.
Health and Flock Data: Any health-related information you submit through our platform (including flock descriptions, symptom reports, photos, or test results) is treated as health-related personal information under applicable law and is handled in accordance with our Privacy Policy. California residents may request access to, correction of, or deletion of this information at any time via our Privacy Rights Request Portal.
Intellectual Property
All content, logos, graphics, and materials on this Site are the property of The Poultry Doc or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Disclaimers
The Site and all services are provided “as is” without warranties of any kind. The Poultry Doc does not warrant that the Site will be error-free or uninterrupted, or that information provided will always be complete or accurate.
Our AI-based tools are not a substitute for in-person veterinary evaluation. Always confirm diagnosis and treatment with a qualified veterinarian.

Limitation of Liability
Your use of the Site is at your own risk. The Poultry Doc is not liable for any damages arising from your use of the Site or its services, except where prohibited by law. Our liability for any product or service is limited to the amount paid for that product or service. Nothing in these Terms excludes liability for gross negligence or willful misconduct where prohibited by applicable law.

Jurisdiction
These Terms are governed by the laws of the State of Texas. The exclusive forum for disputes is the state or federal courts located in Travis County, Texas.
California Residents: Notwithstanding the foregoing, California residents retain all non-waivable rights granted under the California Consumer Privacy Act (CCPA/CPRA) and other applicable California law. Nothing in this Jurisdiction clause limits or waives any statutory rights California residents hold under California law.
